Welcome to the Gaiastarace.com web site (the "Site"). Our services and products presented in the Site are provided subject to the following terms and conditions. If you visit the Site, you agree to be bound by these terms and conditions as in effect at the time of your visit. Please read them carefully. 

LICENSE AND SITE ACCESS

We grant you a limited, revocable license to access and make personal use of the Site as our customer. However, you are not permitted to: 

* reproduce, duplicate, copy, sell or otherwise exploit the Site or any product image, product listing, product description, price, page layout, page design, trade dress, trademark, logo or other content ("Site Content") for any commercial purpose.

* use a robot, spider or data mining or extraction tool or process to monitor, extract or copy Site Content (except in the operation or use of internet "search engines", hit counters or similar technology);

* use any meta tags, search terms, key terms, or the like that contain the Site's name or trademarks used on the Site;

* engage in any activity that interferes with the Site or another user's ability to use the Site;

* modify, create derivative works from, reverse engineer, decompile or disassemble any technology used to provide the Site and the services offered on the Site; or assist or encourage any third party in engaging in any activity prohibited by these Terms of Use. 

Any use of the Site or the Site Contents that is not expressly authorised herein is prohibited and immediately terminates the license granted herein. 

ELECTRONIC COMMUNICATIONS

You consent to receive communications from us by e-mail. You agree that all agreements, notices, disclosures and other communications that we provide to you by e-mail satisfy any legal requirement that such communications be in writing.

EMAIL ADDRESS/PRIVACY POLICY

My Privacy Policy in relation to e-mail addresses is quite simple:

  • Your personal information is kept safe and secure.

  • Your email address is only ever used for the purpose you consented to use it for.

  • Email addresses will never be passed by me to anyone else or any other organisation without your consent. 

  • Subscription option will be provided on the site.

This means your personal information and email address will never be sold, rented, or leased to any other party. Certain third-party service providers, such as payment processors and mailing list service providers, have their own privacy policies in respect of the information that we are required to provide to them in order to use their services.  For these third-party service providers, we recommend that you read their privacy policies so that you can understand the manner in which your Personal Information will be handled by such providers.

YOUR ACCOUNT

If you use the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.  

COPYRIGHT

All content included on the Site, such as, but not limited to, images, text, graphics, logos, and button icons, is the property of Gaia Starace or its content suppliers and is protected by Australian and international copyright laws. The purchase of any product does not provide the purchaser with any copyright interest or other intellectual property right in the product. All content on the Site that is not the property of Gaiastarace.com is used with permission. The arrangement and compilation of all content on the Site are the exclusive property of Gaia Starace and are protected by Australian and international copyright laws.

Refunds, Returns, and Exchanges

Changed your mind? Wondering about returns? All prices on our website are in AUD, and all sales are final since each print is made to order. This means we cannot offer returns, including on gift cards. Please ensure you read the description and size charts carefully before placing your order.

Can I cancel my order or exchange my print? Once an order is placed, it’s final. Because each print is made to order, we cannot accommodate cancellations or exchanges. Please double-check all descriptions and sizes before ordering.

Received a damaged print? We’re here to help! If your order arrives damaged or incorrect, please email us at gaiastarace@gmail.com with your name, order number, and photos of the damage or incorrect item. We'll be happy to assist you.

Order shows as delivered, but you didn't receive it? First, check with the courier and local postal service using the tracking number provided in your shipping notification. Your package might be waiting at your nearest post office. If they can’t locate it, contact us at gaiastarace@gmail.com , and we’ll do our best to help.

Concerned about your order? If you're unsure about your order, we offer the option to create a mock-up design for you. This way, you can be confident in your purchase.

Shipping + Returns 

PURCHASING MY WORK

My work is either available for purchase as an original, limited edition & artist signed prints. All works will include a Certificate of Authenticity and a personalised stamp for authenticity proof. Prints are available with archival, acid free paper (all sizes are printed with a white border to allow for easy framing).

Processing Times:

  • Original Artworks: Please allow 3-5 business days for processing. If I am unavailable at the time of your order, I will notify you of any potential delays.

  • Prints: Unframed prints require approximately 1-2 weeks, while framed prints take 3-4 weeks to prepare.

Express Shipping: We offer express shipping for an additional fee. To request a quote for express shipping, click here.

Shipping Destinations:

  • Australia: We ship nationwide.

  • International: We ship to selected international destinations. Note that framed prints will use Perspex instead of glass to prevent breakage. International shipments of paper prints are sent rolled in a tube.

  • Other: Shipping includes tracking, insurance (for extra cover please contact gaiastarace@gmail.com)

Important Notes:

  • Taxes and Duties: International shipping costs do not cover any taxes or duties imposed by the destination country. These are the responsibility of the recipient. According to Australian export regulations, we must declare the exact value of all items. For more information on taxes, duties, and customs regulations, please contact your local customs office.

Currency: All prices in my shop are in AUD$.

DHL EXPRESS AUSTRALIA

Small= 80 AU (less than 50cm length and height)

Medium= $120 AU (less than 95cm length and height)

Large= $180 AU (anything larger than 95cm length and height)

Artworks are shipped either by the following:

  1. In a cardboard box or padded parcel for smaller items (flat, using a sturdy, well-protected cardboard box, and archival material/foam boards);

  2. PVC/heavy duty tube (especially safe for over-size work, providing a lower shipping costs. Rolled works can be easily stretched and/or framed by a local framer upon arrival);

  3. wooden crate for very large artworks. All prices do not include shipping costs (these are at the expense of the purchaser).

As much as possible I like to re-use materials (such as bubble wrap) to minimize waste towards a more sustainable business. All care is taken to ensure your artwork arrives in mint condition. 

EASY RETURNS & EXCHANGES

For your peace of mind I offer a seven day cooling off period. I want everyone who buys a piece of my art to be completely satisfied and to be able to make a purchase without worry. Once you have received the work you have seven days to live with it to make sure it is the piece for you.

If the artwork has been damaged in the post please keep all packaging and refer to my full returns policy below for further details. I aim for your experience of working with me to be as smooth and positive as possible.

Summary: Please email within 7 days of receiving the goods if you wish to discuss a return. Original delivery charges and return freight/postage costs are the responsibilities of the purchaser. Artworks must be returned in their original condition or a refund will not be issued.

What to Do If the Artwork Arrives Damaged

Step 1 – Within seven (7) days of your merchandise delivery date, please email gaiastarace@gmail.com to give us your order information.

Step 2 - Save original packaging!

Step 3 - Take photos of damaged artwork and packaging. Please email these photos to gaiastarace@gmail.com

Step 4 -  Gaia Starace will contact you to discuss next steps.
